Grounds for Divorce in NY State - If You Cannot Locate Your Spouse
Fee Schedule

An uncontested divorce, for the purposes of the following fee schedule, is where only one spouse has an attorney and all necessary documents will be signed by both parties allowing the divorce to be finalized without a Court appearance.

My current fee schedule is as follows:
Uncontested Divorce without children or property settlement $299.00 plus costs and disbursements.

Uncontested Divorce with children, but no property settlement $699.00 plus costs and disbursements.

Uncontested Divorce with property settlement agreement, but no children $699.00 plus costs and disbursements.

Uncontested Divorce with property settlement agreement and children $799.00 plus costs and disbursements.

Uncontested conversion divorce where Separation Agreement exists and there are no children $299.00 plus costs and disbursements.

Uncontested conversion divorce where Separation Agreement exists and there are children $599.00 plus costs and disbursements.

Costs And Disbursements:

The current costs and disbursements consist of required Court filing fees, the cost of obtaining certified copies of the divorce judgment ($10.00 in Nassau and Suffolk; $17.00 in New York City) and postage and handling costs of $20.00.

The current Court filing fees are as follows:

Divorce without children or property settlement agreement: $335.00 ($340.00 in Westchester)

Divorce with children or property settlement agreement: $370.00 ($375.00 in Westchester)

In the event that your spouse will not sign the required documents there may be a process server's fee of approximately $50.00 ($95.00 if spouse resides in New York City). There may be additional costs to file or obtain a certified copy of an existing Separation Agreement. For any divorce actions filed within the five boroughs of New York City, there will be an additional $17.00 fee for a Court document retrieval service. There may also be additional attorney's fees, costs and disbursements to effectuate a settlement including appraisal fees, the drafting and filing of deeds for the transfer of title to real estate and/or Court Orders to divide pension assets.

If your divorce involves children or a property division and your spouse refuses to sign the necessary documents, but does not take any action to contest the divorce, an uncontested divorce may be procured with a Court appearance, known as an inquest. In the event that an inquest is required to finalize your uncontested divorce, there will be an additional attorney's fee of $500.00 added to above mentioned fees.

Separation Agreements:

If you and your spouse prefer to become legally separated pursuant to a written Separation Agreement, which can be used for a conversion divorce one year later, I can prepare a Separation Agreement for $299.00 (for an agreement which does not involve children); $499.00 for agreement involving children, plus the County Clerk's filing fee ($5.00) and the cost of obtaining a certified copy of the agreement once it has been filed with the County Clerk.

The County Clerks of the five counties of New York City require that an index number be purchased at the time of the filing of the Separation Agreement. The cost of the index number is $210.00.
